1. Acceptance of Terms

By accessing and using Sean Chan's School of Chinese Metaphysics & Astrology (the "School," "we," "us," or "our"), including all content, courses, materials, and services available through https://academy.masterseanchan.com (the "Site"), you agree to comply with and be bound by these Terms & Conditions ("T&C"). If you do not agree to these T&C, you may not access or use the School or the Site.

2. General Provisions and Account Security

  • Eligibility: You must be at least 18 years old to register for the School and use the Site.

  • Modification: We reserve the right to change or modify these T&C at any time. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new T&C.

  • Privacy Policy: Your use of the Site is also subject to our Privacy Policy, which is incorporated by reference into these T&C.

  • Account Security: You are responsible for maintaining the confidentiality of your account login information. You are fully responsible for all activities that occur under your account. You must immediately notify the School of any unauthorised use of your password or account. The School is not liable for any loss or damage arising from your failure to comply with this section.

3. School Content and Intellectual Property

  • Ownership: All content provided by the School, including but not limited to courses, modules, videos, audio, text, graphics, handouts, and any associated materials (collectively, "Content"), is the exclusive property of Sean Chan or its licensors and is protected by copyright and intellectual property laws.

  • License & Access Duration: Upon payment of the required fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Content solely for your personal, non-commercial educational use.

    • "Lifetime Access" Defined: Where a course is sold with "Lifetime Access," this is defined as the lifetime of the Service (the courseā€™s availability on the platform), not the lifetime of the user. If the School decides to discontinue a specific course or the platform entirely, we will provide a reasonable notice period (minimum 30 days) for you to access or download permissible materials.

  • Prohibitions: You may not reproduce, redistribute, share, sell, modify, adapt, publish, transmit, or exploit any Content, in whole or in part, for any commercial or public purpose without the express written permission of Sean Chan. This includes sharing your login credentials with others.

4. Enrollment, Payments, and Refunds

  • Fees: You agree to pay all fees and charges associated with your selected courses or membership plan ("Fees") in accordance with the billing terms in effect at the time the Fee is due.

  • Payment: All payments must be made via the methods specified on the Site.

  • Refund Policy: To ensure clarity, our refund policy is categorised by product type:

    • Pre-Launch / Pre-Order Enrollments: If you purchase a course during a pre-launch period (before the content is released), you may request a full refund at any time prior to the official launch date. Once the course has launched and content is accessible, the standard "Online Courses" refund policy applies starting from the launch date.

    • Online Courses (Video/Module Based): You may request a full refund within seven (7) days of purchase, provided you have not completed more than 20% of the course content. Progress is tracked automatically by our system.Ā 

      • Non-Refundable Items: Due to their immediate nature, no refunds will be granted for:

        • Digital Downloads (e.g., eBooks, PDF Cheat Sheets, Templates).

        • Consulting Services or Live 1-on-1 sessions that have already been scheduled or performed.

        • Membership renewals where the user failed to cancel before the renewal date.

  • Processing Fees: Refunds, when applicable and approved, will be processed for the amount paid, minus any third-party payment processing fees (e.g., Stripe/PayPal fees) incurred during the original transaction. These fees are non-recoverable by us.

  • Cancellations (for Memberships): If you purchase a recurring membership, you may cancel at any time. Cancellation will take effect at the end of the current billing cycle, and you will retain access until that time. No partial refunds will be given for unused time.

5. Disclaimer of Metaphysical and Astrological Advice

  • Educational Purpose Only: The information and instruction provided by Sean Chan's School of Chinese Metaphysics & Astrology are for educational and historical purposes only.

  • Not Professional Advice: The Content, including Chinese Metaphysics, Feng Shui, BaZi, Zi Wei Dou Shu, and related astrological interpretations, is not a substitute for professional, legal, financial, medical, or psychological advice.

  • No Guarantee of Outcome: We make no guarantees regarding the accuracy of the predictions, advice, or results derived from applying the principles taught in the School. You are solely responsible for all decisions and actions you take.

6. User Conduct and Community Guidelines

  • Lawful Use: You agree to use the Site and Content only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site.

  • Prohibited Conduct: You must not engage in any conduct that is unlawful, harmful, threatening, abusive, defamatory, harassing, vulgar, obscene, or invasive of another's privacy, particularly in community forums or live sessions. Users must treat fellow students and the instructor(s) with respect. The School strictly prohibits the posting of illegal, harassing, spam, or promotional material, and reserves the right to monitor or remove any content deemed inappropriate, in its sole discretion.

  • Strict Prohibition on Account Sharing:

    • Monitoring: Our platform uses advanced tracking technology (including, but not limited to, IP address monitoring, device signature analysis, and simultaneous login detection) to identify any instances of shared account access.

    • Violation: Sharing login credentials is a direct violation of our Terms of Service.

    • Penalties: Any account confirmed to be shared will be subject to immediate and irreversible suspension or termination without a refund. We reserve the right to impose a financial penalty for damages incurred.

    • Dispute Process: If your account is suspended for suspected sharing but you believe this is an error (e.g., due to travel or dynamic IP issues), you may contact admin@masterseanchan.com within 7 days to appeal. You must provide proof of identity and explanation of the login anomaly. Reinstatement is at the sole discretion of the School.

7. Limitation of Professional Practice and Misuse of Name

  • No Professional Certification: Sean Chan's School of Chinese Metaphysics & Astrology is an educational institution only. Completion of any course or program offered by the School does not constitute a license, certification, or qualification to practice professionally in Chinese Metaphysics, Feng Shui, BaZi, or any related field.

  • Usage of Name & Credentials:

    • Permitted Use: You may list the courses you have completed in your CV, Resume, or Bio for the purpose of describing your educational history (e.g., "Completed BaZi Intermediate Course at Sean Chan's School of Chinese Metaphysics").

    • Prohibited Use: You may not use the name "Sean Chan," the Schoolā€™s logo, or course titles in a way that implies an affiliation, partnership, endorsement, or "Master-Student" lineage relationship. You may not market yourself as a "Certified Practitioner" or "Disciple" of the School.

  • Severe Action for Misrepresentation: Any unauthorized use, misrepresentation, or implication that your private practice or services are affiliated with, endorsed by, or acting on behalf of the School or Sean Chan will be dealt with severely and may result in immediate and permanent expulsion from the School without refund, termination of your access to the Site, and the initiation of legal action for intellectual property infringement and damages.

8. User-Generated Content & Submissions

If you post comments, submit homework, or share content in our community forums or live sessions ("User Content"), you retain ownership of your work. However, by submitting User Content, you grant the School a non-exclusive, royalty-free, perpetual license to use, display, and modify said content for educational and promotional purposes (e.g., using a student's chart interpretation as a case study in future classes). Where possible, we will anonymize your personal details before such use.

9. Technical Requirements and Service Availability

  • User Responsibility: It is your responsibility to ensure you have the necessary hardware, software, and high-speed internet connection to access the Site and view video content.

  • Service Availability: While we strive to provide 24/7 access, we do not guarantee that the Site will be available at all times. We are not liable for downtime due to third-party hosting failures, maintenance, or force majeure events.

10. Force Majeure

The School shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond the School's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, pandemics, war, or government action.

11. Third-Party Links and Tools

The Site may contain links to third-party websites or resources. These links are provided for convenience only. The School does not endorse, and is not responsible for, the content, products, or practices of these third-party sites. You access and use third-party sites entirely at your own risk.

12. Termination of Access

The School reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Site and Content, with or without notice, for any reason, including, without limitation, a breach of these T&C, non-payment, or violation of the intellectual property or conduct provisions. Upon termination, your license to use the Content immediately ceases, and no refund will be issued for any pre-paid amounts.

13. Limitation of Liability and Indemnification

  • No Warranties: The Site and Content are provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose.

  • Limitation of Liability: To the fullest extent permitted by law, Sean Chan, the School, and its instructors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to or use of the Site or Content.

  • Indemnity: You agree to indemnify and hold harmless Sean Chan's School of Chinese Metaphysics & Astrology from any and all claims, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your breach of these T&C.

14. Governing Law and Jurisdiction

These T&C shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Singapore for the resolution of any disputes.
